Customer Survey Prize Draw (2022)
The Isuzu UTE Australia Aftersales Scheduled Servicing Customer Survey Prize Draw (2022) (“the Competition”) invites certain Isuzu D-MAX or MU-X owners (“Participants”), who complete an Isuzu UTE Australia Aftersales Scheduled Servicing Customer Survey (“Survey”) to go into a lucky dip draw to win a prize. The Participants agrees to the following these terms and conditions (“Entry Terms”):
Terms and Conditions
1. Acceptance of Terms and Conditions
Completion of the Survey is deemed acceptance of these Entry Terms. Information on how to enter the Competition, the prizes and the Survey, are available at www.isuzuute.com.au/aftersales-scheduled-servicing-customer-survey-prize-draw-terms-and-conditions and form part of the Entry Terms.
2. Competition Period
2.1. The Competition commences at 12am AEST on 3/5/2022 and final submissions close at 11:59pm AEST on 31/5/2022 (“Competition Period”).
2.2. A Survey must be fully completed and submitted by the Participant within the Competition Period.
3. Eligibility
3.1. Participation in the Competition is only available to existing owners of an Isuzu UTE vehicle either purchased or that has had a scheduled service between 1/3/2019 and 31/3/2022 (“Eligible Vehicle”). The Promotor has absolute discretion to determine the eligibility of any Isuzu UTE vehicle to participate in the Competition.
3.2. Only one entry per Eligible Vehicle into the Competition is permitted by the Promotor.
3.3. The Promoter reserves the right to verify the validity of an Eligible Vehicle/Participant as an entrant into the Competition.
3.4. The Competition is open to all Australian permanent residents aged 18 years or over. The directors, management and employees, and their immediate families, of the Promoter, their related companies, agencies, suppliers and authorised Isuzu UTE dealers, are not eligible to enter the Competition.
3.5. The Promoter’s decision on eligibility is final and no correspondence will be entered into during and/or after the Competition Period.
4. Reward and Prize
4.1 The prize winners will be randomly chosen from a pool of Participants which have entered the Competition during the Competition Period, in the presence of an independent witness, subject to the eligibility criteria set out in clause 3.
4.2 Skill plays no part in determining a prize winner.
4.3 The prize draw will be conducted at Gadens Lawyers, Level 13 447 Collins Street, Melbourne VIC 3000 at 12pm AEST on 7/6/2022.
4.4 The prize will be delivered to the winner’s mobile phone number via SMS in the form of electronic gift card once the winner’s details have been confirmed. Instructions on how to claim the prize will also be provided by email and the SMS.
4.5 The total value of all prizes is $2,500.00 AUD including GST, which will consist of 25 gift cards in the value of $100.00 AUD each.
4.6 Winners will be notified by email within five days of the prize draw. The winners’ names will be published on 27/06/2022 at www.isuzuute.com.au/aftersales-scheduled-servicing-customer-survey-prize-draw-terms-and-conditions for a period of no less than 28 days.
4.7 Subject to any written direction by a state gaming authorities, should any prize remain unclaimed, an unclaimed prize draw from all non-winning valid entries will take place, in the presence of an independent witness, at the same location as the original draw 12pm AEST 7/9/2022 or at an alternative location specified in accordance with clause 4.3.
4.8 The prize is not transferable or redeemable for cash.
5. General
5.1 If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated by the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) to modify, extend, suspend, terminate or cancel the Competition without prior notice, as appropriate.
5.2 The Competition is not available in conjunction with any other promotion and/or offer.
5.3 The Promoter’s decision in relation to any aspect of the Competition is final and binding for every Participant. No correspondence will be entered into with the Promotor.
5.4 The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmissions interruption, communications failure or otherwise. The Promoter has no control over communications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. In the event that an error with an entry occurs, the Promoter accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. In the event that an error with an entry occurs, the Promoter accepts no responsibility for costs incurred, responses received or any other consequences.
5.5 The winners of a prize must notify the Promoter if their contact details change during the Competition Period.
5.6 The Promoter may require the winner to validate their details at any time prior to being eligible to claim the prize. The Promoter reserves the right to request a winner to provide proof of identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.
5.7 As a condition of accepting the prize, the winner must sign any legal documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form.
5.8 If for any reason any aspect of this Competition is considered in the reasonable opinion of the Promoter to no longer be practical or desirable to run as planned for any reason, is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures, legally binding directive to the Promoter to end any component of the competition or any causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify, extend or suspend the Competition and the Competition Period, subject to any written directions of any relevant authority. In taking such action the Promoter may deem that the Competition closed on a date different to that provided for in these Terms, including a date that has already occurred.
5.9 The Promoter reserves the right, in its sole discretion, to disqualify entry from any person, and prohibit that person's further participation in this Competition, who in the reasonable opinion of the Promoter tampers with, or benefits from any tampering with, the process or the operation of the Competition, acts in violation of these Terms, acts in a disruptive manner, engages in unlawful or other improper conduct, or acts with the intent to annoy, abuse, threaten or harass any other person. The Promoter’s rights to recover damages or other compensation from such an offender are reserved.
5.10 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered (including but not limited to that arising from any person's negligence) in connection with this Competition, in relation to acts or omissions done by Participant or others in the course of entering the competition, and/or any aspect of any prize, except any liability that cannot be excluded by law in which case that liability is limited to the minimum allowable by law.
5.11 Without limiting the previous paragraph, the Promoter and its associated agencies and companies will not be liable for any damage during the transfer of prize.
5.12 The Promoter and their associated agencies and companies accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of the Competition results in, for GST purposes, supplies being made for non-monetary consideration, Participants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
5.13 All entries will be the property of the Promoter.
6. Personal Information & Privacy
6.1 The information Participants provide will be used by the Promoter and participating Isuzu UTE dealers for the purpose of conducting this Competition and to contact Participants that have opted in for offers and promotions or information regarding the Promoter’s products. If the personal information is not provided, the Participant may not be able to participate in the Competition.
6.2 The Promoter may disclose the Participants personal information to its contractors and agents to assist in conducting this Competition or communicating with selected Participants and to State and Territory lottery departments. Winners' names may be published as required under the relevant legislation.
6.3 By contacting the Promoter, Participants can request access to the personal information the Promoter holds about them and/or request not to be contacted by the Promoter and/or its associated companies or agencies for marketing purposes. The Promoter can be contacted on 1300 147 898.
6.4 The Promotor will handle the personal information in accordance with its Information Collection Statement at www.isuzuute.com.au/collection-statement and Privacy Policy at www.isuzuute.com.au/privacy-policy.
6.5 The privacy policy details how a Participant may access the personal information that is held by the Promoter and seeks correction of such information; and how you may complain about a breach of the Australian Privacy Principles, and how the Promoter will deal with such a complaint.
6.6 The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth.), as well as any other applicable laws.
